Spain severance pay calculator: what it is and how it works

Severance pay (indemnización por despido) is the compensation a Spanish employer must pay when ending a contract in certain cases. Under the Workers’ Statute it depends on the reason: 33 days’ pay per year worked for unfair dismissal (up to 24 months’ pay), 20 days per year for objective or collective dismissal (up to 12 months’ pay) and 12 days per year when a temporary contract ends. A disciplinary dismissal ruled fair carries no severance.

For employees who started before 12 February 2012, unfair dismissal is calculated in two parts: 45 days per year up to that date and 33 days afterwards. Periods shorter than a year are prorated by months, counting part of a month as a full month. The daily salary is the annual salary, including extra payments, divided by 365.

How to use it

  1. Choose the type of dismissal or termination.
  2. Enter the contract start and end dates.
  3. Enter your gross annual salary including extra payments and read the severance.
FormulaSeverance = daily salary × days per year × years of service (subject to legal caps)

Worked example

For a contract from 1/3/2019 to 31/10/2026 and €30,000 gross a year, unfair dismissal means 253 days’ pay: €20,794.52. If the dismissal is objective, 153.33 days: €12,602.74.
